Minutes of the January 10, 2005 Annual meeting of Oak Creek Homeowners Association and minutes of the January 10, 2005 Board Meeting.

 

Minutes of the Annual meeting:

 

Election of three new members to the governing board.

There were only three people who volunteered for the board and they were elected unanimously.  Two new members of the board are: Mark Faulhaber and Jim Lee.

Tom Hytry was the third member who was reelected.

 

Leaving the board were Fred Krug (last year’s Treasurer) and Dave Hanck.  Special thanks were given to them for all of their hard work for The Association.

 

Fred Krug reported that The Association ended the year with $42,970 in reserve (up from $31,016 at this time last year).  This was more than double the $5000 that the board is trying to increase in the reserve account each year.

 

Vote on the two amendments to the Covenants:

 

As of the homeowners meeting on January 10, 2005 only 21 people have returned their ballots on the two amendments.  Amendments to the Covenants require written approval of Ύ of the association members or 52 yes votes.  We are sending out the amendments again in the minutes.  If you did not reply please do.  We need either 52 yes votes or 19 no votes (1/4).  Ballots can either be return by mail to Avenue 1000 or faxed to Carol Smith at their office (630) 985-6775.  Ballets can also be returned to any board member.

 

The two changes to the covenants that are out for ballot are:

 

1)      Change Article III section 1: which states ”No ..more than two domestic animal pets … shall be kept or maintained on any lot.” To “No .. more than four domestic animal pets, of which no more than three shall be dogs, … shall be kept or maintained on any lot

 

2)      Add to Article III – section 12 and new subsection H): which will state:  “Any external structural modification to an existing home needs to have prior written approval by the Architectural Review Committee.”

 

The first change reflects the fact that a number of homeowners currently have 3 dogs, which is not currently causing any problems.

 

The second change fixes a hole in the covenants in terms of what is covered by the Architectural Review Committee

 


 

Minutes of the January 2005 Board Meeting

 

After the association annual meeting the board held it first meeting.

Present were all five board members: Beth Johnson, Adam Sarauskas, Mark Faulhaber, Jim Lee and Tom Hytry.

Committee reports included a list of who will be working on which committees.

We appreciate the new homeowners whom have volunteered. However, most of the homeowners listed below have served on the given committees before and we need to get more homeowners involved on these committees.  The Homeowner Association is only has good as the people who help run it.

Proposed Amendments to Covenant and By-Laws – January 2005

 

     Covenant amendments must be approved in writing by three- fourths (75%) of the owners of real property in Oak Creek Subdivision. Not replying is the same as a NO vote.

 

The actual changes to the indicated covenant section are in Underlined Bold Italics.

 

Amendment One: Increases the number of pets allowed by a homeowner from 2 to 4 with no more than three allowed to be dogs:

 

Article III Section 1.  Land Use and Building Type: is changed as follows:

 

                        All lots covered hereby shall be used for single family, private residential purposes only, unless designed for the other purposes on the master plan.  No gainful occupation or profession, or other non-residential use, shall be conducted on any lot(s) or in any building located on any lot(s).  No noxious or offensive activity shall be carried on in or upon any premise, nor shall anything be done thereon which is or may be or become any annoyance or nuisance to the neighborhood.  No livestock (including horses and farm animals), poultry, or more than four domestic animal pets, of which no more than three shall be dogs (only dogs and cats shall be considered domestic animal pets for the purpose of this covenant) shall be kept or maintained on any lot, said owner shall at all times secure their said animals so as not to infringe upon or cause a hazard to other owners or their property.  Dogs and cats must be contained on owner's premises or on a leash in other areas.  No burning of refuse shall be permitted outside any dwelling, except that the burning of leaves naturally upon the premises is allowed.  Commercial vehicles shall not be habitually parked in the subdivision.  "Commercial vehicles" shall include all forms of transportation which bear signs or have printed on the same reference to any commercial undertaking or enterprise.  In addition, no trailers, mobile homes, or recreational vehicles of any kind shall be habitually parked in said subdivision unless within a garage located thereon.  Habitually parked for purposes of these restrictions shall be defined as parked in said subdivision, not within a garage located thereon, for a period in excess of three (3) consecutive days.

Amendment Two: Adds subsection to require Architectural Review Committee approval for an homeowner to make an external structure change to their homes.
