Minutes of the December 6, 2004 Oak Creek Homeowners Board Meeting

 

Meeting was called to order at 7:00 p.m.

 

Board members present: Tom Hytry, Fred Krug, Adam Sarauskas and Dave Hanck.

 

The following homeowners were also present: Sandy Worzala, Carole Crum, and Don Hahn.

Annual Meeting: The date for the annual meeting was set for Monday, January 10, 2005 at 7:00 p.m. at the Oak Creek Clubhouse.  There are three board positions up for election.  We encourage everyone to get involved – it is your community.

Website: We currently have a web site www.oakcreekhomeowners.org. The web site is what we want to make it.  Sent any comments or suggestions to webmaster@oakcreekhomeowners.org.

 

Secretary’s Report: The minutes of November 1, 2004 were approved.

Treasurer's Report:  Budget is on track.  Currently we have $38,700 in reserve. One homeowner has a past due balance. Avenue 1000 sent a reminder letter in November.

Club House: Farm Colony Homeowners Association asked if they could rent the clubhouse for their meetings (about 3 times a year).  The board approved the request for rent at $190 per time (with a $250 deposit) with a maximum of three times a year. They will let us know if still interested.

 

Grounds: Getting bids for snow removal. Previous service provider is no longer plowing snow.

 

By-Laws:  The board recommends the passing of the following two changes to the covenants:.

 

Two changes to the covenants that will be proposed at the December meeting:

 

1)      Change Article III section 1: which states ”No ..more than two domestic animal pets … shall be kept or maintained on any lot.” To “No .. more than four domestic animal pets, of which no more than three shall be dogs, … shall be kept or maintained on any lot.”

2)      Add to Article III – section 12 and new subsection H): which will state:  Any external modification to an existing  home needs to have prior written approval by the Architectural Review Committee.”

 

The first change reflexes the fact that a number of homeowners currently have 3 dogs, which is not currently causing any problems.

 

The second change fixes a hole in the covenants in terms of what is covered by the Architectural Review Committee

 

(See attachment for ballot – we need ¾ of the homeowners to return a yes vote for the above to pass.  Not replying is a no vote)

 

New Business: Avenue 1000 has requested an increase in what they charge us (from $580 to $620 a month) for management fees.  They have not raised the rate in 4 years.  The board approved the raised provided Avenue 1000 agrees not to raise the rate for the next 3 to 5 years. Avenue 1000 agreed to hold the fee for 3 years.

Proposed Amendments to Covenant and By-Laws – January 2005

 

     Covenant amendments must be approved in writing by three- fourths (75%) of the owners of real property in Oak Creek Subdivision. Not replying is the same as a NO vote.

 

The actual changes to the indicated covenant section are in Underlined Bold Italics.

 

Amendment One: Increases the number of pets allowed by a homeowner from 2 to 4 with no more than three allowed to be dogs:

 

Article III Section 1.  Land Use and Building Type: is changed as follows:

 

                        All lots covered hereby shall be used for single family, private residential purposes only, unless designed for the other purposes on the master plan.  No gainful occupation or profession, or other non-residential use, shall be conducted on any lot(s) or in any building located on any lot(s).  No noxious or offensive activity shall be carried on in or upon any premise, nor shall anything be done thereon which is or may be or become any annoyance or nuisance to the neighborhood.  No livestock (including horses and farm animals), poultry, or more than four domestic animal pets, of which no more than three shall be dogs (only dogs and cats shall be considered domestic animal pets for the purpose of this covenant) shall be kept or maintained on any lot, said owner shall at all times secure their said animals so as not to infringe upon or cause a hazard to other owners or their property.  Dogs and cats must be contained on owner's premises or on a leash in other areas.  No burning of refuse shall be permitted outside any dwelling, except that the burning of leaves naturally upon the premises is allowed.  Commercial vehicles shall not be habitually parked in the subdivision.  "Commercial vehicles" shall include all forms of transportation which bear signs or have printed on the same reference to any commercial undertaking or enterprise.  In addition, no trailers, mobile homes, or recreational vehicles of any kind shall be habitually parked in said subdivision unless within a garage located thereon.  Habitually parked for purposes of these restrictions shall be defined as parked in said subdivision, not within a garage located thereon, for a period in excess of three (3) consecutive days.

Amendment Two: Adds subsection to require Architectural Review Committee approval for an homeowner to make an external structure change to their homes.

 

Add as new subsection H to Article III, section 12 that states:

 

Any external modification to an existing home needs to have prior written approval by the Architectural Review Committee.
